By creating an account, accessing our platform, or using any part of the Services, you affirm that you are at least 18 years of age and that you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

2. DESCRIPTION OF SERVICES

Primoris provides an Artificial Intelligence-driven platform designed to perform preliminary patent prior art searches and trademark clearance analysis. Our platform utilizes advanced Large Language Models (LLMs) and automated querying of official databases (e.g., USPTO).

3. NOT LEGAL ADVICE (CRITICAL DISCLAIMER)

• Informational Purpose: All output, including risk intelligence reports, novelty gap analysis, and suggested pivots, is for informational and research purposes only.
• No Attorney-Client Relationship: Your use of the Services does not create an attorney-client relationship between you and Primoris.
• Requirement for Professional Review: The AI engine may produce inaccurate or incomplete results. You are solely responsible for independently verifying all data and consulting with a qualified intellectual property attorney before making any legal or business decisions.

4. USER ACCOUNTS & SECURITY

• Registration: You must provide accurate and complete information during registration.
• Account Security: You are responsible for safeguarding your password and for all activities that occur under your account.
• Password Requirements: We enforce strict password complexity requirements (minimum 8 characters, containing uppercase, lowercase, numbers, and symbols) to protect your intellectual property data.

5. PAYMENTS, TOKENS, AND BILLING

• Search Credits: Searches are performed using pre-purchased credits. One token equals one comprehensive analysis.
• Flat Fee Pricing: Unless otherwise specified, tokens are sold at a flat rate of $249.99 USD.
• Refund Policy: Tokens are non-refundable once an analysis has been initiated. If a technical error prevents the completion of a report, the token will be automatically credited back to your account.

6. INTELLECTUAL PROPERTY RIGHTS

• User Content: You retain all ownership rights to any source documents, claims, or descriptions you upload.
• Platform Rights: Primoris retains all rights, title, and interest in and to the platform, including its software, AI prompts, report templates, and branding.
• Feedback: Any feedback provided regarding the platform may be used by Primoris without restriction or compensation.

7. DATA RETENTION & PRIVACY

Primoris operates under a Zero Data-Retention Policy. We do not store your uploaded source documents on our servers beyond the duration of the analysis. Once the analysis is complete, source files are purged from our temporary storage (Vercel Blob).

8. PROHIBITED USES

You agree not to use the Services to:

• Reverse-engineer the Primoris AI logic.
• Upload documents you do not have the legal right to share.
• Automate search queries via scripts or bots without explicit authorization.
